Terms
A private sale between two individuals, in Germany, under German law. Not a shop, not a trader, no company behind it. Clause 04 is the one worth reading: precise descriptions become binding, which is the point of them.
I sell watches from my own collection as a private individual (Privatverkauf). I am not a registered trader, I run no business, and I do not charge VAT — these are used goods on which it was paid long ago. This is a one-off disposal of a finite private collection: forty-six watches, no additions, and the site closes when they are gone.
A listing is an invitation, not a binding offer. A contract exists once I have confirmed availability in writing and you have paid the bill of sale. Until then either of us may walk away without reason.
Prices are in euro and hold until I change them. Each watch is a single piece; if two people ask at once, the first to pay has it and I tell the other the same day.
Condition is agreed condition. Everything stated in the listing and in How I describe condition is a warranted characteristic of that particular watch (vereinbarte Beschaffenheit). I cannot and do not exclude liability for any of it.
Beyond that agreed condition, the sale is made excluding liability for material defects (unter Ausschluss der Sachmängelhaftung) — the ordinary position in a private sale of a sixty-year-old mechanical object. This exclusion does not apply where I have concealed a defect I knew of, misdescribed something, or given a guarantee, nor to injury to life, body or health, nor to intent or gross negligence.
These watches are between thirty and ninety years old. They are not water-resistant whatever the caseback says, they will not keep quartz time, and they need servicing roughly every five years. None of that is a defect.
As a private seller I owe you no statutory right of withdrawal — that right exists only against traders in distance selling. I nevertheless grant fourteen days from delivery to return anything for any reason, as a matter of goodwill, on the terms set out on the Buying page. It is a promise I have made in writing and you may rely on it.
Take any watch to a watchmaker of your choosing before you pay. If they find something I failed to disclose, return it and I refund everything including postage both ways.
Risk passes on delivery. Everything ships insured for its full value; loss or damage in transit is between me and DHL.
